This policy describes the privacy practices of PBJSNAP, LLC (referred to in this policy statement as “PBJSNAP,” “we,” or “us”), with respect to its web site and online service operated under the “PBJSNAP!” brand (collectively, the “PBJSNAP Service”) and related electronic communications with Visitors and Subscribers or Subscriber Users (as those terms are defined below). We are aware of the privacy concerns of our online visitors and subscribers. We share your concerns and are committed to protecting your privacy.

This privacy policy applies to persons visiting the public portions of the PBJSNAP web site (“Visitors”) as well as to persons who register to use online service (“Subscribers”) or, if the Subscriber is a company, about the Subscriber’s authorized users of PBJSNAP Service (“Subscriber Users”).

Any use of the PBJSNAP web site is subject to the Terms of Use posted on such web site, and any use of the online service is subject to the Subscription Agreement that is accepted in the course of registering for a subscription or any written agreement we enter with the Subscriber in lieu of that Subscription Agreement (each, as applicable, the “Agreement”).

This privacy policy is applicable only to the PBJSNAP Service and does not apply to any third party web sites or to other companies or persons. The PBJSNAP Service may contain links to, and media and other content from, other sites. In addition, such third-party media and content also may contain external links. Because of the dynamic media capabilities of the PBJSNAP Service, it may not be clear which links are embedded in the PBJSNAP Service and which are embedded in third-party media and/or content. PBJSNAP cannot and does not guarantee the privacy policies and practices of any third party. PBJSNAP does not control, operate, or endorse any information, products, or services of any third-party web sites that may be reached through links from the PBJSNAP Service. The use of any personal information provided to such a third party will be governed by that party’s privacy policy. If you are unsure whether a web site is controlled, affiliated, or manage by PBJSNAP, you should review the privacy policy at each linked web site to determine how that site treats your personal information.

PBJSNAP may change this privacy policy from time to time. The revised policy will be posted on the PBJSNAP Service. You should check the PBJSNAP Service periodically for changes.

This privacy policy does not apply to information disclosed to or obtained by PBJSNAP other through the PBJSNAP Service.

The PBJSNAP Service is a general audience site and PBJSNAP does not knowingly collect personally-identifiable information (“PII”) from children under 13 years of age. If you believe we might have any information from or about a child under 13, please contact us.

Information We Collect

PBJSNAP does not collect PII about Visitors and Subscribers or Subscriber Users through the PBJSNAP Service unless the information is provided to us voluntarily. Visitors may use portions of the PBJSNAP Service without registering or providing PII. To register as a Subscriber for the PBJSNAP Service, which is required to use most features of the PBJSNAP Service, we require Subscribers or Subscriber Users to provide certain PII about themselves or, if the Subscriber is a company, about the Subscriber Users as well as to create a user name and to provide a password.

PBJSNAP Subscribers or Subscriber Users also may choose to provide additional information about themselves in their Registration (as defined in the Agreement).

PBJSNAP may use certain technology on our web site to collect information from Visitors and compile aggregate statistical information about how the web site is used, including without limitation information relating to the frequency of visits, the average length of visits, which pages are viewed during a visit, and the links to other web sites invoked during a visit, the domain name and IP address from which Visitors are connecting, and the type and version of web browser, but it is not personally identifiable except as described below regarding IP addresses (“Aggregate Data”). In addition, PBJSNAP may take the personal information of Subscribers or Subscriber Users and create anonymized information by excluding information that makes it personally identifiable to such persons (“Anonymized Data”).

PBJSNAP may compile logs of IP addresses of Visitors for administrative and analytical purposes. PBJSNAP does not routinely collect any PII through its compilation of IP addresses or the locations of computers on the Internet, but in cases of suspected violation of the Agreement or service problems, PBJSNAP may use an IP address in conjunction with other PII to enforce the Agreement and/or to protect or troubleshoot the PBJSNAP Service, its users, or others who may be affected. Except as otherwise provided in this privacy policy or the Agreement, PBJSNAP will not share with third parties any PII associated with IP addresses.

PBJSNAP may record information about Visitors’ and Subscribers’ or Subscriber Users’ usage, such as when and how the PBJSNAP Service is used. If you are logged in as a Subscriber or Subscriber User, we may associate that information with your Registration. We may use clear GIFs (also called web beacons) in HTML-based e-mails sent to Visitors or Subscribers to track which e-mails are opened by recipients.

PBJSNAP also may use cookies on the PBJSNAP Service. Cookies are small text files that are placed on the computer’s hard drive by our servers to identify that computer to our servers. Except as otherwise provided in this privacy policy or the Agreement, no PII stored in the PBJSNAP cookies will be shared with outside companies for any purpose without permission. You can disable cookies or otherwise manage them through tools provided with your browser software and with third-party software packages, or not use the features that require cookies, but if you choose to reject our cookies, some areas of the PBJSNAP Service may not function properly.

We and our advertisers may use third-party companies to serve ads when Visitors and Subscribers or Subscriber Users visit the PBJSNAP Service. These third-party ad-serving companies may also place cookies on your computer. Sometimes these cookies may be used to provide targeted advertising to you. These advertising companies also may use web beacons to help manage and optimize our online advertising.

PBJSNAP may use the information it collects, including without limitation the personal information of Visitors and Subscribers or Subscriber Users, Aggregate Data, and Anonymized Data, for any lawful purpose that does not involve disclosure in contravention of this privacy policy, including without limitation to provide Subscribers or Subscriber Users with access to their Registration, to provide services that Visitors, Subscribers, or Subscriber Users have requested, to enhance and improve our services, to provide customized advertising to you to conduct research, to determine Visitors’ and Subscribers’ or Subscriber Users’ geographic location or other demographic information, and to analyze usage patterns.

PBJSNAP reserves the right to send Subscribers or Subscriber Users certain communications relating to their subscriptions or the PBJSNAP Service, such as service announcements and administrative messages. You cannot opt out of these messages.

Information We Share

Except as set forth below, unless we have a Visitor’s, Subscriber’s, or Subscriber User’s consent, it is our policy not to sell, rent, license, or provide personal information about Visitors and Subscribers or Subscriber Users to any unaffiliated third party unless we are required to do so by judicial, legal, or other government proceedings or we have a duty to do so.

In the course of our business, we may share some or all of the information described above among our affiliates. PBJSNAP also may share PII with third-party service providers who help us in the operation of the PBJSNAP Service and who have agreed to maintain the confidentiality of the data as well as with other third parties to offer products or services that may complement Visitors’ or Subscribers’ relationships with us. PBJSNAP also may access or disclose PII or non-PII Registration information of Visitors, Subscribers, or Subscriber Users without providing notice or a choice in order to protect or defend the legal rights or property of PBJSNAP, our affiliates, or their employees, agents, and contractors (including enforcement of the Agreement); to protect the safety and security of users of the PBJSNAP Service or members of the public, including acting in urgent circumstances; to protect against fraud or for risk management purposes; or to comply with the law or legal process. In addition, if PBJSNAP sells all or part of its business or makes a sale or transfer of all or a material part of its assets or is otherwise involved in a merger or transfer of all or a material part of its business, PBJSNAP may transfer PII to the party or parties involved in the transaction as part of that transaction.

Non-U.S. Users

PBJSNAP is hosted and operated entirely in the United States and is subject to United States law. Any personal information provided to PBJSNAP or provided through the PBJSNAP Service is being provided solely in the United States and will be hosted on United States servers. If you are accessing the PBJSNAP Service from outside the United States, please be advised that United States law may not offer the same privacy protections as the law of your jurisdiction.

Your California Privacy Rights

California Civil Code Section § 1798.83 permits users of our web site that are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. To make such a request, please contact us.
